I was written up at work and suspended for a day for a picture I took up at work...

...and used on myspace.? I took the picture with my phone and uploaded it to my page, my district manager looked at the page and wrote me up for doing it. She then suspended me and the other person in the picture for one day without pay. Is that legal even though I was not on the clock or even scheduled to work that day?

Keep your outside activities away from your job. Don't take them to work. Simple as that.

Probably not, but the fight you'll need to get into could cost more than the pay lost.If you are a union member, go see your shop steward. If not suck it up and quit goofing off at work.
